1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and ConnectPlus Mobile Network ("we," "us," or "our"), concerning your access to and use of our mobile services, website, and related services.
By accessing or using our services, purchasing our mobile plans, or using our network, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access our services or use our network.
2. Service Provision
2.1 Service Availability
We provide mobile telecommunications services including voice, SMS, and data services. Service availability may vary based on location, network coverage, and technical conditions. We strive to maintain 99.7% network reliability but cannot guarantee uninterrupted service.
2.2 Service Plans and Pricing
All service plans, pricing, and features are subject to change with 30 days' notice. We reserve the right to modify or discontinue service plans without notice. Current pricing and plan details are available on our website and in service agreements.
2.3 Service Acceptance
All service applications are subject to acceptance, credit checks, and identity verification. We may refuse or cancel any service application for any reason, including creditworthiness, suspected fraud, or network capacity limitations.
2.4 Billing and Payments
Customers are responsible for timely payment of all charges. Late payments may result in service suspension or termination. Billing disputes must be reported within 30 days of invoice date.
3. Intellectual Property Rights
Unless otherwise indicated, the website and all associated content are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the website (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.
The Content and Marks are provided on the website "AS IS" for your information and personal use only. Except as expressly provided in these Terms, no part of the website and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
4. User Representations
By using our services and network, you represent and warrant that:
- You have the legal capacity and you agree to comply with these Terms;
- You are at least 18 years of age or have parental consent;
- You will not access our services through automated or non-human means;
- You will not use our services for any illegal or unauthorized purpose;
- Your use of our services will not violate any applicable law or regulation;
- You will use our network in accordance with acceptable use policies;
- You provide accurate and complete registration information.
5. Prohibited Activities
You may not access or use our services for any purpose other than that for which we make the services available. Our services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a user of our services, you agree not to:
- Use the service for any unlawful, fraudulent, or malicious activities;
- Transmit spam, unsolicited communications, or bulk messaging;
- Engage in activities that disrupt network performance or integrity;
- Attempt to gain unauthorized access to our systems or networks;
- Use the service to harass, abuse, or harm another person;
- Make improper use of our support services or submit false reports;
- Use the service in a manner inconsistent with applicable laws;
- Resell or redistribute our services without authorization;
- Use services for auto-dialing, continuous call forwarding, or call center operations without appropriate plan;
- Engage in excessive data usage that impacts network performance;
- Use services for cryptocurrency mining or similar resource-intensive operations;
- Tamper with SIM cards or attempt to clone devices;
- Use services while operating a vehicle without hands-free equipment.
6. Service Usage
6.1 Acceptable Use
ConnectPlus mobile services are designed for personal and business communication. Users are responsible for ensuring they use services in compliance with all applicable laws and regulations.
6.2 Network Management
We may manage network traffic to ensure optimal performance for all users. During periods of congestion, data speeds may be temporarily reduced for users who have consumed large amounts of data.
6.3 Roaming Services
Roaming services are subject to partner network availability and additional terms. International roaming usage must comply with fair use policies and may be subject to additional charges for non-EU destinations.
6.4 Equipment
Customers are responsible for ensuring their devices are compatible with our network and properly configured. We are not responsible for device malfunctions or compatibility issues.
7. User Generated Contributions
Our services may enable you to submit content through various channels. Any content you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:
- The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights of any third party.
- You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us to use your Contributions.
- Your Contributions are not false, inaccurate, or misleading.
- Your Contributions are not unsolicited or unauthorized advertising, promotional materials, spam, or other forms of solicitation.
- Your Contributions are not unlawful, defamatory, obscene, invasive of privacy, abusive, illegal, harassing, or otherwise objectionable.
8. Third-Party Services and Content
Our services may include or provide access to third-party services, applications, and content. We are not responsible for any third-party services, websites, or content accessed through our network.
Such third-party services and content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any third-party services accessed through our network or any third-party content posted on, available through, or installed from our services.
9. Service Management
We reserve the right, but not the obligation, to:
- Monitor service usage for violations of these Terms;
- Take appropriate legal action against anyone who violates the law or these Terms;
- Refuse, restrict access to, or limit the availability of services;
- Manage network resources to ensure quality service for all users;
- Suspend or terminate service for violation of these Terms;
- Otherwise manage services to protect our rights and property and facilitate proper functioning.
10. Customer Support and Services
10.1 Technical Support
ConnectPlus provides customer support during business hours through multiple channels. Emergency network support is available 24/7 for service-affecting issues.
10.2 Service Maintenance
We perform regular network maintenance to ensure service quality. We will provide reasonable notice of scheduled maintenance that may affect service availability.
10.3 Service Changes
We may modify, suspend, or discontinue any aspect of our services with reasonable notice. Material changes to terms or pricing will be communicated 30 days in advance.
11. Term and Termination
These Terms shall remain in full force and effect while you use our services. We may suspend or terminate your service for violation of these Terms, non-payment, or fraudulent activity. All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Disclaimer
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH OUR SERVICES AND YOUR USE THEREOF.
WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF SERVICE INFORMATION AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY SERVICE INTERRUPTIONS, NETWORK OUTAGES, OR TECHNICAL ISSUES BEYOND OUR REASONABLE CONTROL.
13. Limitation of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.
CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
14. Indemnification
You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of: (1) your use of our services; (2) breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms; (4) your violation of the rights of a third party; or (5) any illegal or unauthorized use of our services.
15. Governing Law
These Terms and your use of our services are governed by and construed in accordance with the laws of Hungary without regard to its conflict of law principles.
16. Changes to Terms
We reserve the right to make changes or modifications to these Terms at any time. We will alert you about any material changes by updating the "Last updated" date of these Terms and providing 30 days' notice for significant changes.
It is your responsibility to periodically review these Terms to stay informed of updates. You will be subject to changes in any revised Terms by your continued use of our services after such revised Terms are posted.
